Sexual Assault Prevention and Response (SAPR)

Mission: The National Guard Bureau is committed to eliminating incidents of sexual assault by instituting a comprehensive policy that focuses on increasing awareness through prevention and education, victim centered support, intimidation free reporting, thorough investigation, and accountability for those who commit sexual crimes. The goals of the Sexual Assault Prevention and Response Program:

  • Establish sexual assault training and awareness programs to educate Soldiers and Airmen
  • Ensure that leaders understand their roles and responsibilities regarding the care and treatment of sexual assault victims
  • Ensure that leaders understand their roles and responsibilities in thoroughly investigating and reporting allegations of sexual assault
  • Create a climate that encourages victims to report incidents of sexual assault through the chain of command
  • Establish systems that, should an incident of sexual assault occur, victims receive the sensitive and immediate comprehensive care and treatment they need to restore their health and well-being
  • Ensure that sexual assault crimes are thoroughly investigated and that offenders are held accountable for their crimes
  • Ensure that reporting mechanisms are in place to track trends in sexual assault and the effectiveness of response capabilities
  • Track sexual assault training and awareness programs to ensure compliance with NGB policy

All eligible NG members, dependents, and civilians will have access to Restricted Reporting and Unrestricted Reporting options so they may file an official report of sexual assault.

  • NG members who were sexually assaulted in a duty status IAW reference l and in a non-duty status are eligible for SAPR services and may select the RR or UR option.
  • NG members who were sexually assaulted before enlistment or commissioning are eligible for SAPR services and may select the RR or UR option.
  • Dependents of NG members who are at least 18 years old are eligible for SAPR services and may select the RR or UR option.
  • Title 32 United States Code (U.S.C.) non-dual status civilian employees and Title 5 U.S.C. civilian employees may receive SAPR services with both reporting options, RR and UR. Line-of-duty entitlements are not applicable.
  • State active duty NG members are eligible for limited SAPR services, both RR and UR options, and limited State benefits as defined by State law, which may consist of limited healthcare services in the form of emergency care.
  • NG members sexually assaulted while performing active duty in Title 10 U.S.C. status are eligible to receive SAPR services from NG SAPR personnel upon return to Title 32 U.S.C. status after signing a "Victim Reporting Preference Statement," reference e, consenting to the transfer of their case.

Restricted Reporting
A reporting option that allows sexual assault victims to confidentially disclose the assault to specified individuals, such as Sexual Assault Response Coordinators (SARC), Victim Advocates (VA), or healthcare personnel without triggering an investigation. Victims have confidential access to medical treatment, counseling, CATCH, DoD Safe Helpline, Chaplain, Special Victims Counsel (SVC), SARC, and/or Victim Advocate. The victim may elect to convert a Restricted Report to an Unrestricted Report at any time.

Unrestricted Reporting
A reporting option that allows sexual assault victims to disclose the assault, without requesting confidentiality or Restricted Reporting, and may trigger an investigation. Victims have access to medical treatment, forensic exam, counseling, DoD Safe Helpline, Chaplain, Special Victims Counsel (SVC), SARC, and/or Victim Advocate. They may also be eligible for a Military Protective Order, Civilian Protective Order, No Contact Order, Line of Duty (LOD) determination, and Expedited Transfer. The victim cannot convert an Unrestricted Report to a Restricted Report, but they may choose to stop participating in the investigation or legal process at any time.

Note: Mandatory Reporting Laws and Cases Investigated by Civilian Law Enforcement
Health care may be provided and sexual assault forensic exam (SAFE) kits may be performed in a civilian healthcare facility bound by State and local laws that require certain personnel (usually health care personnel) to report the sexual assault to civilian agencies or law enforcement. In some cases, civilian law enforcement may take investigative responsibility for the sexual assault case, or the civilian jurisdiction may inform the military law enforcement or investigative community of a sexual assault that was reported to it. In such instances, it may not be possible for a victim to make a Restricted Report or it may not be possible to maintain the report as a Restricted Report. Consistent with Reference (q), to the extent possible, DoD will honor the Restricted Report; however, sexual assault victims need to be aware that the confidentiality afforded their Restricted Report is not guaranteed due to circumstances surrounding the independent investigation and requirements of individual State laws for civilian healthcare facilities.

  • What is CATCH?

    The CATCH program allows victims of sexual assault the opportunity to anonymously submit suspect information to military criminal investigators to help the DoD identify serial offenders. To make a CATCH entry, victims of sexual assault can contact a Sexual Assault Response Coordinator (SARC) or Victim Advocate (VA).
